The thing that happened in the Olive Garden Gluten-Free Lawsuit is something that isn’t that rare. Like, time and again, there have been cases where restaurants don’t pay attention to the requests made by their customers, but when they miss it, and when it has a lot to do with health concerns of the customers, it almost always leads to a lawsuit like this. So, if you don’t know the full backstory of this one, then let’s get to the details and see what went down and how this could have been easily avoided, but things kept on escalating.

Who Is Involved In This Case?
The focus of the case is on Robert Anthony Bayton, a Kentuckian who claims that he has celiac disease. He is the person that have brought the lawsuit against Olive Garden on this issue.
According to the news, the restaurant that is the subject of the case is an Olive Garden branch in Lexington, Kentucky. The complaint also refers to a waitress who served him but the name has not been reported publicly. Apart from Bayton and Olive Garden, a third person associated with this case is Bayton’s attorney, Christopher Hayden.
What Happened At The Restaurant?
According to the complaint, this event took place in August 2024 when Bayton was having dinner at Olive Garden in Lexington. He is said to have informed the waitress that he has celiac disease and absolutely cannot consume gluten.
Subsequently, Bayton requested the waitress if it would be possible for the restaurant to make him a gluten-free fettuccine Alfredo. The complaint states that the waitress told him that the Olive Garden can definitely accommodate such a request. However, Bayton claims, that in fact the biggest problem arose after that.
What Is Bayton Accusing Olive Garden Of?
Bayton’s lawsuit is alleging that even after he made his condition known to the staff, Olive Garden failed to serve him a safe meal.
Basically, his position is that he told them about his very serious gluten-related health issue, requested a gluten-free meal, was even promised that the meal would be safe, but in the end, he was served the wrong food.
The lawsuit was brought against Olive Garden for negligence. That means, Bayton is essentially stating that the restaurant in this case did not exercise a reasonable level of care. He is arguing that both the restaurant and the server were aware, or at least should have been aware, that the ingestion of gluten by him could result in a serious health impairment.
It is also pointed out by the complaint that the error was not identified and remedied prior to the meal being served.
Besides that, Bayton is claiming that due to this mistake, he sustained what the complaint refers to as major and permanent injuries. In fact, this is one of the leading causes why this lawsuit has attracted so much attention.
What Does Olive Garden Say About Gluten-Free Food?
That is actually the point that makes the whole case even more intriguing. In fact, according to news, Olive Garden does carry a gluten-free pasta option on its menu. Therefore, Bayton thought he had a good reason to trust the restaurant in providing him with a meal that was suitable for his needs.
On the other hand, Olive Garden also clearly states that its dishes are made in kitchens where gluten is present. Basically, even if the restaurant makes efforts to cater to special dietary requirements, there still remains the possibility of cross-contact. This simply means that gluten can accidentally come into contact with food that has been designated as gluten-free.
Furthermore, there is another aspect worth mentioning here. According to reports, the website of Olive Garden specifies that their Alfredo sauce contains gluten.
This fact turns out to be quite a significant one since it was the fettuccine Alfredo dish that the lawsuit centered on. So naturally, this particular fact has led to even greater focus being placed on the matter.
